Passed in July 2023, the Community, Assistance, Recovery, and Empowerment (CARE) Act created a new pathway to deliver mental health and substance use disorder services to individuals who are diagnosed with schizophrenia or other psychotic disorders who are substantially deteriorating and unlikely to survive safely in the community without supervision. Kern County's participation in the CARE Act program began in October 2024. 

Implemented on January 1, 2026, California Senate Bill 27 expanded the eligibility criteria for inclusion in the CARE Act Program. The CARE Program will now be available to individuals with a diagnosis of Bipolar I Disorder with Psychotic Features as well as individuals who are facing charges for misdemeanors and/or felonies and found incompetent to stand trial. The legal expansion also includes individuals who were not foreseen to benefit from mental health diversion or assisted outpatient treatment. 

The goal of the program is to prevent those with severe mental health disorders from entering into more restrictive conservatorships or incarceration. Families, clinicians, first responders, and others may begin the process by completing the CARE Court referral form or by filing a petition directly with the Superior Court of Kern County to connect adults to court-involved voluntary treatment.

By focusing on a holistic, person-centered approach, the CARE Act aims to break the cycle of homelessness and incarceration for these individuals and promote long-term recovery through a court process. This approach seeks to create a safer and healthier community for all residents.
