Patients' Rights Advocacy

Even while under an involuntary hold, your loved one retains important rights under California law, including:

  • The right to be treated with dignity and respect
  • The right to receive appropriate mental health treatment
  • The right to refuse medication, unless there is a legal order (e.g., Riese hearing)
  • The right to a Certification Review Hearing before an extended hold
  • The right to speak with a Patients' Rights Advocate
  • The right to contact and be visited by family, unless restricted for safety reasons
  • The right to file a complaint or grievance if they believe their rights have been violated

Patients' Rights Advocates are part of Kern Behavior Health and Recovery Services. An advocate is automatically assigned to represent your loved one in Certification Review Hearings and is available to provide education and consultation on the laws governing mental health treatment, including involuntary holds.
